A Florida law that took effect October 1, 2026 (SB 488) expands the state's ability to send driver license suspension, revocation and cancellation notices by email instead of regular mail, for drivers who have authorized email notice. It sounds like a paperwork change, but it can make a real difference if you are ever charged with driving while license suspended (DWLS).
In Florida, driving on a suspended license is a crime only if you knew your license was suspended. Without knowledge, it is a noncriminal moving violation. Under section 322.34, the State can prove knowledge in a few ways:
Under the new law, the notice is considered complete 20 days after the email is sent, the same as 20 days after a letter is mailed.
A conviction can also extend your suspension or lead to a habitual traffic offender designation.
The same law raises the amount of apparent property damage that requires you to report a crash to police, from $500 to $2,000. Crashes involving injury or death must still be reported.
If you were cited or arrested for driving with a suspended license, call Rainka Law at (904) 329-7245. We will look at whether the State can actually prove you knew.
